Kochi: A Judicial First Class Magistrate Court in Keralam will pronounce its order on Saturday on the bail plea of the prime accused in the Mini Cooper crash near Kochi that killed three youngsters.
Angamaly Judicial First Class Magistrate Samyuktha M K on Friday heard the bail application of Suhail (19), who was allegedly driving the car when it rammed a scooter carrying three youngsters in the early hours of October 11.
The three victims, including two women, were around 21 years old.
Police arrested four persons, including Suhail, in connection with the accident. The other accused are Ninav, Ameer and Joel.
A medical examination reportedly revealed a high level of alcohol in Suhail's bloodstream, following which the police invoked additional charges against him.
Opposing the bail plea, the prosecution told the court that there was strong evidence against the accused, including witness statements and CCTV footage.
Blood and urine tests indicated that Suhail was heavily intoxicated, the prosecution submitted.
It also argued that the investigation was at a crucial stage and that the accused had been in police custody for only two days, which was insufficient for the probe.
Suhail's counsel argued that the three victims were travelling on a scooter in violation of traffic rules.
The counsel contended that there was no direct eyewitness to the accident and that the charge of culpable homicide not amounting to murder was not sustainable.
The defence alleged that the police were sensationalising the incident and argued that there was no evidence to establish that the car was being driven at high speed.
Family members of Gopika (21), one of the victims, also filed a petition seeking to be impleaded in the case.
After hearing all parties, the court posted the matter for orders on Saturday.
SFI activists staged a protest on Friday near a shop owned by Suhail's mother in Palarivattom.
Police stopped the protesters before they could reach the shop. Following a tussle with the police, the activists raised slogans near the shop and dispersed, officials said.
The shop has remained closed since Monday following the accident, police said.
